User Agreement Policy
Service Commitment - WesTex Connect will provide you with a monthly service that begins the first day service is activated and automatically renewed on the same terms and conditions contained herein.
Rates - All incurred charges for internet service are calculated to the first of the month and due by the tenth of the month. Any account that payment has not been received by 10th of the month will result in applicable late fees. Any account that payment has not been received by 20th of the month will result in temporary suspension of account until payment is rendered. WesTex Connect reserves the right to increase any and all rates upon thirty (30) days notice to you, during the term of this Agreement.
Cancellations - Thirty (30) days notice is required on ALL cancellations and MUST be made in writing (either mailed, dropped by, or by email) stating desired termination of services. All cancellations made on or after the first of the month will be subject to a full month's charge.
Account Termination - Any account that violates any statements in this user policy shall be terminated at once with all charges still owed for the month of usage. Any account that payment has not been kept current shall also be terminated with amount still owed.
Assignment - Without prior written consent of WesTex Connect, you shall not assign, transfer, pledge, or hypothecate this Contract. Sharing of account information is prohibited. Double logging is prohibited without the purchase of another internet account and will result in cancellation of service.
Credit Information - You consent to WesTex Connect's receipt and disclosure of account information to or from credit reporting agencies, credit bureaus, private reporting associations, or to/from other providers of internet service at any time during your service or upon delinquency with WesTex Connect.
Non-Payment/Breach - A late payment charge of 28% APR may be applied to any account that has become over 30 days delinquent and necessary actions have not been made to make arrangements to pay account. If WesTex Connect obtains the services of a collection agency and/or attorney to assist in collection on breach of this Agreement, including but not limited to the non-payment of charges, the costs and expenses incurred by WesTex Connect will be paid by you.
Reconnect Fee - A $25 plus tax reconnect fee will be added and owed at time of reconnect to any account that is disconnected and/or cancelled and must be reconnected.
Returned Checks - A $30 service charge will be made by WesTex Connect for any check or other negotiable instrument tendered by you and returned unpaid for any reason.
Late Fees - A late fee will be added to any account not paid by the 15th of the month in which the service was billed.
Paper Fees - A paper fee will be added to any monthly statement and/or invoices that are sent via postal mail to help offset postage and supplies.
Taxes/Fees/Additional Charges - Texas Sales & Use Tax and any other fees including but not limited to E911 Charges, Cost Assessment Charges, Regulatory Cost Recovery Charge, State Universal Service Charge, FCC Fee, Federal Universal Service Fee, Fuel Surcharge, Property Tax Fee, Utility Pole Attachment Charge, Administrative Fee, and any other necessary surcharges including the internet service cost recovery charge may be applied to any account as applicable for services and vendor.
Disputes/Credits - Customer has sixty (60) days to make a dispute/credit request in writing from date of occurrence. This request must include specific details and/or documentation. If the credit request is in regards to a tax exemption, the credit will be no more than sixty (60) days. Any other taxes paid in error may be requested as credit to the entity they are exempt from such as the Texas Comptroller of Public Accounts for Texas Sales & Use Tax exemption. Customer also understands that credits for outages are not issued unless approved and for more than two consecutive 24 hour periods for commercial accounts and three consecutive 24 hour periods for residential accounts of downtime. These periods are days during regular operating hours and do not include weekends or holidays. NO CREDITS will be issued if due to electrical loss on either party’s end or due to fiber cuts, acts of nature, or other actions deemed uncontrollable on either party’s end.
Governing Law - This Agreement shall be governed by the laws of the State of Texas and shall be performable in Taylor County.
REFUSE SERVICE - WesTex Connect reserves the right to refuse service to anyone for any reason at any time.
While using WesTex Connect, you may NOT:
- Restrict or do harm to the system.
Especially to
stop any other user from using and enjoying the internet. Post any
transmit any information or software which contains a virus and/or
trojan horse.
- We ask that all users please do not
transmit any
type of spam, mass distribution, or solicited email or news group
posting for any purpose whatsoever.
- Distribute in any way software through WesTex Connect which is protected by copyright law.
